Cattany <br />Division Director <br />Natural Rgource Trustee <br />Re: Juniper Quarry, Permit No. M-1982-141, Amendment Application AM-U1, Preliminary <br />Adequacy Review (PAR). <br />Dear Mr. Steele: <br />The Division of Minerals and Geology has begun the review process for the above referenced <br />amendment to the Juniper Quarry. Please review these initial issues and respond with a <br />clarification or corrections as noted. <br />1) The applicant initially submitted the application on March 6"', 2005. On March 6"', the <br />Division sent out not cation of an incomplete application with a number of items noted. <br />Moffat Limestone incorrectly began the Public Notice as required under Rule 1.6(d) prior <br />to the initial submittal date. The Office notfied Moffat Limestone on April 15"', 2005 that <br />the application was complete for review after receiving the additional information <br />requested. Therefore, by Rule the application was considered filed on the 15"' of April <br />2005. Please re-DUblish the Notice required in 1.6(d). Per Rule 1.6.6 since the notice is <br />in error, all deadlines shall begin anew. Therefore, staff is setting a new Decision Date of <br />August 8"', 2005. Should all issues be resolved before that date and no objections <br />~~jj received, staff will make a decision prior to that date. <br />( 2~ There is a discrepancy between the Maps C and C-1 and the information provided on C- <br />~~ 2. Specifically, Poirt 7 on Map C-2 is noted in a direct line with Points 2 and 3 <br />respectively. However, on C and G1 this point is referred to as Point 8. Since C-2 <br />describes a Point 8. Please correct mans so that all data matches. <br />~In the Mine Plan, it describes the removal of topsoil and brush. Please saecifv a clear <br />4) Does the denoted acreage include the 2.2 acres noted for the new haul road? Please <br />cla <br />5) The Mining Plan narration notes aforty-foot thickness of limestone. Please clarify that <br />the final highwall height DroDOSed is the same height. <br />6) The Mining Plan does not reference fuel storage on site. Please clarify ff fuels will be on <br />site and if so what measures for spill control will be undertaken. <br />7) It is noted that a time frame for this operation is "impossible" to predict. If a mining <br />operation does not operate more than 180 days a year k may be put into an intermittent <br />status. Please review the definition for intermittent status and see if this operation meets <br />
