The issuance of the <br /> permit does not assure the applicant that no injury will occur to another vested water right or preclude another <br /> owner of a vested water right from seeking relief in a civil court action. <br /> 2) Approved pursuant to CRS 37-90-137 (2) and (I 1)(A)(1) for the diversions of ground water tributary to the Boulder <br /> Creek and the South Platte River system. Ground water shall be diverted only pursuant to the water exchange <br /> contract between the owner and the Water Users Association of District 6 dated February 4, 1985 or a court <br /> approved plan for augmentation. All diversions must comply with the amended rules and regulations of the State <br /> Engineer for the South Platte River and its tributaries. <br /> I <br /> 3) The average annual amount of ground water to appropriated shall not exceed 83 acre-feet with the total surface <br /> area of the proposed ground water ponds limited to 41.5 acres. i <br /> 4) The owner shall mark the well (ponds) in a conspicuous place with well permit number(s) and court case number(s) <br /> as appropriate. He shall take necessary means and precautions to preserve these markings. <br /> I <br /> 5) The boundaries of the gravel pit ponds shall be more than 600 feet from any existing well. <br /> 6) During gravel mining operations the use of ground water is limited to gravel washing and dust suppression. Upon i <br /> completion of gravel mining operations the use of ground water is limited to evaporation losses only. No other use <br /> of water is allowed unless a permit therefor is approved.
