Ms. Erica Crosby <br />-Iaxch 30,2007 <br />Page 10 <br />equilibrium level below the peak rise in the water, however, we believe such a temporary <br />measure is warranted to provide flexibility as we near the end of the filling process. <br />NEW CKD DISPOSAL PLAN <br />As indicated in the February 26, 2007 letter from DRMS (Erica Crosby) to CEMEX <br />(Monica Sowders), CEMEX has agreed to evaluate and submit a new disposal plan fox <br />CKD that will eliminate dust suppression water. As has been discussed at previous <br />meetings, CEMEX is required by the Colorado Department of Public Health and the <br />Environment, Air Pollution Control Division to use water sprays to mixumize fugitive dust <br />during CKD disposal operations at C-Pit. Any proposed modifications to current operating <br />procedures at C-Pit to reduce ox eliminate water sprays must be coordinated with the Air <br />Pollution Control Division and DRMS. <br />Once the filling of the water body in C-Pit is completed, the water level stabilizes, and the <br />hydrogeologic conditions at the site are better defined, future CKD disposal in the eastern <br />portion of C-Pit will continue in the dry conditions established by filling. As discussed in <br />recent meetings, CEMEX will be installing two access points (vertical xfsexs) in the eastern <br />portion of C-Pit during the filling process that will allow pumping of residual subsurface <br />water in the event our analysis indicates such pumping is warranted. <br />Please fmd enclosed a check fox $188 to cover the fee fox this Technical Revision.
