The foregoing covenants and indemnification obligations shall <br />survive any termination of this Easement. <br /> <br />SECTION B. COOPERATION AND REMOVAL OF AOAD. Grantor agrees <br />to provide to and for Grantee such consents and waivers which <br />Grantor is capable of providing, and to refrain from entering or to <br />withdraw such objections or protests, as Crantee may reasonably <br />request with respect to any permit or other governmental approval <br />or action relating to Grantee's use of the Right-of-Way Easement <br />and the conduct of mine operations in the vicinity of the Property. <br />Grantee may seek to obtain the permission of the appropriate <br />regulatory authorities to leave and not reclaim and remove any road <br />or other facilities which may be constructed by Grantee on the <br />Property, and Grantor agrees to provide to those regulatory <br />authorities such requests and consents as Grantee may reasonably <br />request in order to obtain such approval, inclutling but not limited <br />to, an undertaking by Grantor to assume all responsibility and <br />liability for such road after closure of the mine. Grantor <br />acknowledges that if Grantee is unable to obtain such regulatory <br />approval to leave any such facilities, Grantee shall remove such <br />facilities and the Property shall be reclaimed in accordance with <br />applicable laws. <br />SECTION 9. COVENANTS RUNNING WZTH THE LAND. All of the <br />easements, restrictions, covenants and agreements set forth in this <br />Easement are intended to be and shall be construed as covenants <br />-6- <br />
