GRANTOR'S RIGHTS TO EASEMENT PROPERTY. Grantee <br />shall have the exclusive right to the easement and to use of any <br />road constructed on the Property by Grantee; provided, however, <br />that Grantor shall have the right, at its risk, to use such road <br />only for purposes related to its coal mining business. Any use by <br />Grantor of such road or the Property shall not interfere with <br />Grantee's use of such road or its other rights hereunder, and <br />Grantor shall indemnify and hold Grantee harmless from any claim, <br />demand or liability (including litigation expenses) arising from or <br />related to the use of the Property or the road by Grantor. Grantee <br />shall have the right to use the easement for the location and use <br />of rip rap, aggregate, gravel or other rock mine facilities <br />(hereinafter referred to as "rip rap"), including, but not limited <br />to, the use of roads for rip rap haulage purposes, powerlines and <br />related facilities and other utilities related to mine operations, <br />topsoil stockpiles, ditches, impoundments and any and all other <br />uses related to or necessary or convenient for rip rap mining and <br />preparation operations, environmental studies, exploration and <br />surveying activities, storage and stockpiles of materials, mine <br />construction, reclamation and environmental monitoring activities, <br />and access on and across the Property with any persons, machinery, <br />-2- <br />
