Pertinent statutory citations : <br /> 34-32-116 (7) (g) - Disturbances to the prevailing hydrologic balance <br /> of the affected land and of the surrounding area. . . shall be <br /> minimized. <br /> 34-32-116 (2) - Reclamation plans shall be based upon provisions <br /> for, or satisfactory explanation of, all general requirements for <br /> the type of reclamation chosen. The details of the plan shall be <br /> appropriate to the type of reclamation designated by the <br /> operator. . . <br /> 34-32-116 (7) (b) - Reclamation plans and the implementation thereof <br /> shall conform to the following general requirements : Earth dams <br /> shall be constructed, if necessary to impound water, if the <br /> formation of such impoundments will not . . .damage adjoining <br /> property. <br /> II . S . : An Assessment <br /> Report, Vol . 2, Federal Interagency Floodplain Management Task <br /> Force, FIA-18/June, 1992 . <br /> In floodplains where a regulatory floodway has not been designated, <br /> Federal Insurance Administration (FIA) minimum regulations require <br /> that no development be permitted within the one percent annual <br /> chance floodplain that would - individually or cumulatively with <br /> other anticipated development - increase that water surface <br /> elevation of the base flood by more than one foot . <br /> The regulations provide for mapping areas behind levees as <br /> protected from the one percent annual chance flood only if the <br /> levee system provides protection from that flood, as determined <br /> through application of FEMA-established design criteria for <br /> freeboard, closures, embankment protection, embankment and <br />
