Revision. <br />Dear Ms. Williams: <br />v~ <br />Benson Brothers hereby petitions for a hearing btrfore the Mined Land Reclamation Boazd regazding the <br />denial of our technical revision request to use water from the BB Seep for dust suppression at the <br />permitted site referenced above. We do not feel that additional off-site impacts will be created by using <br />the seep pond and existing access road to fill water trucks. The water will be obtained from the BB Seep <br />by driving a water truck down the existing access road to the seep pond and setting the suction-line from <br />the truck mounted pump into the pond to fill the water track. The access road to the seep pond was <br />previously used for this purpose by local fire trucks to fill their tanks and was also used by Quinn Coal <br />Company to fill water trucks for dust suppression at their coal mine- These facts were verified by Joe <br />Belden, the previous owner of the seep pond- We contend that the impact would be no different than <br />using any other off-site water source to fill the water truck and no additional reclamation would required <br />by using this source. <br />Please let me know when we will be scheduled for a hearing and if there is any additional information you <br />require.
