~~
~-
sources, Inc. ~
5ss
RECEIVED
DEB 2 8 2001
February 26, 2007
Glenda Williams
Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, CO 80203
Division of Reclamation,
`~ Mining and Safety
RE: Benson $rothers Red Shale Pit; File No. M-2005-07T I'R-Ol, New water source for dust
suppression. Revision.
Dear Ms. Williams:
v~
Benson Brothers hereby petitions for a hearing btrfore the Mined Land Reclamation Boazd regazding the
denial of our technical revision request to use water from the BB Seep for dust suppression at the
permitted site referenced above. We do not feel that additional off-site impacts will be created by using
the seep pond and existing access road to fill water trucks. The water will be obtained from the BB Seep
by driving a water truck down the existing access road to the seep pond and setting the suction-line from
the truck mounted pump into the pond to fill the water track. The access road to the seep pond was
previously used for this purpose by local fire trucks to fill their tanks and was also used by Quinn Coal
Company to fill water trucks for dust suppression at their coal mine- These facts were verified by Joe
Belden, the previous owner of the seep pond- We contend that the impact would be no different than
using any other off-site water source to fill the water truck and no additional reclamation would required
by using this source.
Please let me know when we will be scheduled for a hearing and if there is any additional information you
require. 'T'hank you for your assistance in this matter.
Sincerely,
Michael Ripp
Consultant
PO.
