7. The excavation of the settlement pond will involve about 300 cubic yards of material from
the pit floor. Will that excavated material be retained nearby onsite to facilitate backfilling
during reclamation, or be removed from the site?
Your responses to the items listed above are important for this office to reach a decision on the
technical revision, and to determine whether the $1,500 bond will still be adequate. Please note
that this office is required to review the bond amount during the technical revision process.
The decision date is currently set for June 13, 2002. If no response is received from you by that
date, the request for technical revision may be denied. If you need additional time to prepare and
provide your responses, a written request for extension maybe submitted.
If you have questions, I may be contacted at the Division's Durango field office. The address is:
Division of Minerals and Geology, 701 Camino del Rio, Room 125, Durango, CO 81230; The
telephone is 970/247-5193 and fax is 970/247-5104.
I look forwazd to reviewing your responses
Sincerely,
~eb ~;~
Bob Oswald
Environmental Protection Specialist
Cc: Rudy and Deb Rudibaugh, 711 Ranch, Pazlin, CO 81239
A:~rudibaugh trOlad/rco
