Lung <br />Div~s~on Director <br />During our February 19th meeting, which included <br />representatives of Battle Mountain Resources (BMRI), RCG/Hagler- <br />Bailly (RCG/HBI), and the Division, we resolved a numbed of topics. <br />Several of our resolutions implied modifications to t~e existing <br />Memorandum of Understanding between the Division and B I. In the <br />interest of expediting amendment of the M.O.U., I ~ropose the <br />following minor modifications. <br />Section V. ADMINISTRATION OF THIRD PARTY SAMPLE COLLECTION <br />Amend paragraph A.1, "Sampling Location and Frequency"', to read: <br />1. Independent sampling, and subsequent samp}e analysis <br />conducted by an analytical laboratory retained by the <br />third party sampling contractor, shall be conducted at <br />DMG's directions once during the first three <br />calendar months following approval of the TR No. 006 <br />protocol and the execution of the Contract+ and twice <br />during each of the three subsequent three (3) month <br />periods _..,, ~..:..., a,._:.._ a_..,. Samples collected hereunder shall be anal)!zed by the <br />independent analytical laboratory designated) by DMG for <br />the following parameters: Total Cyanide, WiAD Cyanide, <br />a-»d Copper and Nitrate Nitrite second. and third <br />sampling rounds, onlvl in accordance with t e approved <br />analytical protocol set forth in TR No. 006. <br />We also discussed a selection of editorial changes to the Draft <br />report for the first sampling round. We anticipate the receipt of <br />Dr. Maest's amended report next week. Dr. Posey will c6mplete his <br />
