It was our intention to mine the 9NtiVHG to cross-cut #3, stopping east of the projected lease <br />line. After replotting the lease line based on the true surveyed position, we found that we have <br />mined beyond the western limits of the C-136? lease as shown on the attached drawing. <br />We are notifying you of this discrepancy, and wish to emphasize that at no point was it our <br />intention to mine beyond the lease line. The accompanying maps will show the exact locations of <br />projected vs. surveyed lease lines and the extent of encroachment. <br />It is our desire to "square up" cross-cut #3 as originally intended and as shown on the mine map. <br />We have passed cross-cut R2 enough that it would be a significant operational impairment to not <br />continue ahead. <br />This issue was discovered late yesterday (November 3, 1994) afternoon. Mining in this area w•as <br />immediately ceased until a solution is reached.
