No other NOV's have been <br />issued at this operation during the past twelve months. <br />SERIOUSNE6S <br />Seriousness is assessed at $500 as moderate. Pond discharges in <br />excess of NPDES effluent limits had apparently occurred, although <br />the discharge volume was small. Ther® was no evidence of ofP-site <br />damage. There apparently is some question es to the adequacy of <br />sampling due to samples being collected at a point other than the <br />discharge point. Therefore, the quality of the discharge may have <br />been better or worse than indicated by the sample data. <br />FAULT <br />Tha operator was negligent in not correcting the faulty discharge <br />device upon recognition of the problem when it was .identified. <br />$500 is assessed for negligence. <br />GOOD FAITH <br />5250 is awarded for rapid compliance.
