Mr. Dan Hernandez
September 25, 1989
Paae Four

Unless the geotechnical engineer indicates a problem
with mulch or mulch and netting, we would recommend this qusicker
erosion control technique. With regards to tree planting, I:he
State Forest Service recommends a 700-800 tree/acre plantin~~
program, reference page two in the July 11, 1909, division report
titled "Assessment of the Application of Criteria for the
Achievement of Forest as a Post Mining Land Use." I assume these
are bare root stock, if the operator plants containerized si:ock,
what would be the Forest Service recommendation? Is it fair to
plant seedlings for the loss of mature trees? In my opinion, it is
not fair.
In conclusion, it appears the first step in curing the violations is
completing a coordinated, comprehensive set of consultant reports addressing
drainage of the access road and phase I, sedimentation pond designs for a 100
year storm event, roadway design consisting of slope stabilization and
vehicular restraint, end finally revegetation and tree planting. Without
properly addressing and curing these problems, I have no choice but to
continue to object to the proposed Amendment III application. If I ce~n
clarify or further document these items, please feel free to call on nie. I
have appreciated your efforts and those of other staff, and Mr. Oanta's.
Sincerely,
Gregor/~~el, P. E.
Enclosures
cc: Party Status Participants
