The enclosed <br />photographs illustrate that there currently exists significant siltation and <br />sediment along the length of the stream bed. The photographs also deoict <br />significant rock-falls starting along the quarry access road and ending in the <br />bottom of the canyon along the stream bed. These are photographs of areas not <br />previously documented in your inspection report. <br />If you vuould like to walk this stream bad and see the additional rock-falls <br />and eroded areas first hand, I would be glad to accompany you. The s~~rvey <br />would require approximately two hours of moderate to strenuous hiking. I <br />believe these conditions are a violation of the duties of an operator as <br />described per Colorado Revised Statute 34-32-116, (7)(g)(h)(i). I am not <br />requesting an additional hearing on these items if the operator will I;ooperate <br />and complete a comprehensive clean up of the access road. <br />6Jithin the notice of violation dated July 6, 1939, there are seven arl;as <br />catalogued as needing corrective work. I believe this quantity may put <br />"blinders" on the operators view of the problem. Erosion and sedimentation <br />producing materials occur the length of the access road. Therefore tlTe <br />corrective actions need to occur the length of the access road. <br />Present plans to remedy the violations are incomplete and disjointed. Various <br />consultants are vuorking for the operator; however, there is a need to <br />coordinate, and integrate the road building efforts and violation remedies.
