amaRe Liability Agreement <br />Albert Frei Fi Sons, Inc, has made application to dte Colorado Mincd Lands Reclamation Board for an <br />amendment to reclamation pcrmit (Permit # M-77-526) to expand their existing Worthing Pit sand and <br />gravel operation located in Section 26, Township 1 South, Range 67 West, Went the intersection of Brighton <br />Road and 132nd Street, Adams conttty, Colorado. <br />Albert prei A; Sons, lac. agrees to compensate D4r. Kem~eth M. Bromley Cor any damage caused by the <br />sand and grnvel mining operation to any man-made snuchues located within 200 feet of the amended mine <br />pemrit boundary approved by Colorado Mined Lands Reclamation Board. In addition, Albert Prei ~ Sons, <br />inc. agrees to compensate Mr. Kenneth M. Rrom]ey for any material damage to shallow wells (Permit i!s <br />153350 or 15966) or water rights caused by the proposed sand and gravel mining operation under amended <br />reclamation permit NM-77-S26. In the unlikely event that dewatering under emended permit itM-77-57.6 <br />afferrs the water rabic or availability oCwater in well #s 153350 or 15966, Albert Frei Rc Sons, hrc. agrees <br />to compensate Mr. TCenneth M. Aromley by providing an alternate water supply. The alternate water will be <br />supplied by.eitha drilling a new well or by pumping water from dewatering, to provide nn adequate <br />amount of water Cor the livestock on Farccl fl0157126000017. <br />'this Damage Liability Agreement shall he binding upon the parties listed below and shall be effective nn <br />the date the Colorado Mined Lands Reclmm~timt Roard approves Albert feel & Sons, Inc.'s rcqucst for an <br />amendment to Fermit /!
