Elizabeth Pacheco <br />Costilla County Administrator <br />3~2 Main St. <br />San Luis, CO 81152 <br />RE: San Acacio Pit (Permit No. NI.99-024) Reason to believe a violation exists <br />~~ <br />D I ~ I S I O V O F <br />MINERALS <br />GEOLOGY <br />0.ECLAMt'ICN <br />MI NING•$AFE'° <br />eal ow?nt <br />Garernor <br />Greq E.'+~alcher <br />E..ecun~e D,reaor <br />~`mc`tael B. long <br />D,nson D'vector <br />On December 16, 1999 we conducted an inspection of your thine and found evidence of damage outside <br />the boundaries of the approved permit/affected azea in the form of grading and sloping of lands into the <br />pit. <br />We believe this is in violation of C.R.S. 34-32.5-116(4)(1) which requires [hat azeas outside of the affected <br />land shall be protected from slides or damage occurring during the [Hitting operation and reclamation. <br />Therefore, we have found reason to believe a violation exists to Permit M-99-024 and the Law and have <br />scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the 7anuary 26-27, 2000 Board meeting for consideration of <br />a possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beooiruting at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will have the <br />opportunity to be represented and heard. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, assess a civil penalty in <br />the amount of 100.00 to $1,000.00 for each day of violation and may order the permit be suspended, <br />modified or revoked.
