Date of <br />inspection was August 30, 1995. Division observed lees than one acre of <br />disturbance outside the permit area including about 0.1 acre of partially <br />reclaimed pit area and areas with topsoil stockpiles. <br />The Division re-evaluated the bond for this operation. The new financial <br />warranty amount ie $20,200.00. The due date for the revised amount is <br />November 20, 1995. <br />Seriousness: Zones <br />D C OB A <br />(A) Administrative Violation, or Some On-Site Damage <br />(B) Little Off-Site Damage, Moderate On-Site Damage, No Health or <br />Safety Hazard <br />(C) Little Off-Site Damage, Significant On-Site Damage, and/or <br />Possible Health or Safety Hazard <br />(D) Off-Site Damage, and/or Significant Health or Safety Hazard <br />History of Violations in Paet Twelve Mont he: None <br />Staff Recommendation: <br />Violation: Find a violation of C.R.S. 34-32-109(1) and (2) for mining <br />without a permit and/or C.R.S. 34-32-116(1), 34-32-116(7)(h) <br />and Rule 3.1.5(3) for failure to protect areas outside the <br />permit area from damage during the mining operation and <br />reclamation. <br />Cease and Deeiet: Recommended for all mining activities for areas <br />outside the present permit area. <br />Corrective Actions: <br />1.) File an amendment to the 110 permit or a 112 conversion by <br />12/19/95 which includes the following: <br />a.) If a 110 amendment is done, submit a revised mining plan and <br />reclamation plan to include all disturbed offeite areas, the <br />current mine area and wash plant and revised maps showing all <br />disturbance included in this permit, or <br />b.) File a complete 112 conversion with all necessary exhibits. <br />2.) Get the 110 amendment issued by no later than 1-19-96 or get <br />the 112 conversion issued by no later than 3-19-96 (if no <br />objections) or 4-18-96 if objections are received. Issuance <br />can not be achieved until proper bond ie posted. <br />Civil Penalty Range $50 - $200 per day. If $50 a day is added for <br />history, daily penalty may not exceed $150 + $50: <br />$50-$150/day x 49 days = $2,450 - $7,350 if in violation of C.R.S. <br />34-32-116(1) and 34-32-116(7)(h) <br />or <br />$0 to $3,000 if mining without a permit <br />C:\YP51\83702BRD.FRM <br />
