ORDER
Based on the foregoing, the Board hereby enters the following order:
(1) BMRI stated in their Hydrogen Peroxide Tailings Treatment TR-007 application;
"Existing WAD (weak acid dissociable) cyanide concentrations in the tailings
impoundment will be reduced to less than 50 ppm...Peroxide will continue to be
added directly to the liquid pools until the WAD cyanide concentration drops
below 50 ppm."
If BMRI has not achieved tailings impoundment WAD cyanide level of 50 ppm or
less by July 3, 1992, BMRI shall immediately notify the Divisio~ and cease
operation of the ore processing plant until it has achieved theireduced WAD
concentrations.
WAD (weak acid dissociable) cyanide levels shall be determined jn accordance
with APHA/AWWA Standard Methods, 17th edition, method 4500-C.
(2) After July 3, 1992, if the WAD cyanide levels within the tailin~s impoundment
rise above 50 ppm, BMRI shall immediately notify the Division a d cease
operation of the ore processing plant until the WAD cyanide lev 15 have
returned to 50 ppm or lower.
(3) Immediately following the Division's approval of technical revi ion application
TR-008, BMRI shall submit well permit applications for the two roposed
additional monitoring wells. Further, BMRI shall contact Mr. G orge Van Slyke
of the Division of Water Resources to request verbal approval t proceed with
installation of the two monitoring wells. The Division will re uest that DWR
expedite approval of these well permits. ~.
Within thirty days following receipt of verbal approval from th DWR to install
the monitoring wells, BMRI shall install, complete, hydrologically test,
geophysically log, and sample the wells. BMRI shall also evalu to the data and
submit a report presenting BMRI's conclusion regarding the necessity of
additional ground water monitoring modifications.
Within thirty days following the Division's approval of the eval ative report
submitted in accordance with TR-008, BMRI shall install and complete any
necessary additional ground water monitoring wells.
If BMRI fails to meet any of the above deadlines, or any leakageis detected
from the tailings impoundment, BMRI shall immediately notify the Division and
cease operation of the ore processing plant.
(4> BMRI is to use all reasonably practical steps to continue to low~r the cyanide
levels in the pond to the lowest reasonably achievable levels, a d to continue
to use its best efforts at all times to achieve that goal. BMRI shall attempt
to lower the WAD cyanide to a target level of 35 ppm by July 20,1992. If at
any time the staff, or other parties, believe that BMRI is not doing everything
reasonably practical, BMRI can be brought back to the Board for further action,
including civil penalties and further corrective action orders.
