E. Cessation Order C-85-069 issued on July 22, 1985 was for "Failure to
contemporaneously reclaim". This CO related to the entire site.
Abatement for this enforcement action is to "Reclaim site in accordance
with Rules and Regulations".
La Plata proposes to remove all accumulated trash or debris and remove
any unnecessary structures. La Plata proposes to retain the "crushing
and loadout facility area", the "conveyor", and the portals due to
anticipated future coal mining plans. Since these actions are in
accordance with the required abatement, these actions are deemed
appropriate by the Division.
La Plata proposes fixing and surfacing the deteriorating access road to
allow for access to the upper bench for purpose of reclamation and
clean up. Included in this fixing will be the installation of drainage
ditches along the side of the road to reduce previous erosion
problems. As long as the requirements for "Access Roads" as described
pursuant to Rule 4.03.2 of the Regulations of the Colorado Mined Land
Reclamation Board for Coal Mining are complied with, the Division deems
this action appropriate.
III.
