Long <br />Division Director <br />On August 3, 1998, you delivered a map of the affected area of the Gardner Gravel Pit, Permit <br />No. M-79-034, meeting the first corrective action noted in the June 25, 1998-inspection report. <br />Based on the map submitted to the Division, it is appazent that mining operations have been <br />conducted outside of the approved affected area boundary. Therefore, there is a reason to believe <br />that a violation exists for mining outside the approved affected area or that the operator is mining <br />without a permit. <br />The possible violation and correction actions are noted as follows; <br />Possible Violation <br />The operator failed to first obtain a reclamation permit prior to engaging in a new <br />operation in accordance with 34-32.5-109(1) of the Colorado Land Reclamation Act for <br />the Extraction of Construction Materials or the operator failed to protect areas outside of <br />the affected land from slides or damage during the mining and reclamation operations in <br />accordance with 34-32.5-1 l6(4)(i) of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials. <br />Corrective Actions <br />Submit a new application to replace Permit No. M-79-034 that: <br />revises the total affected area to incorporate all present and future disturbances <br />that have occurred and/or will occur as a result of this operation; <br />
