The waivers are attached for your reference. <br />The two remaining wells are the only groundwater users within the cone of depression that <br />results from full dewatering of the pit with no recharge activities. Although NCCI has waivers for <br />these two wells, NCCI proposes to install recharge ditches/ponds along the perimeter of the <br />mine in order to limit the extent of the cone of depression/radius of influence to that of condition <br />2 above (360 feet). This will minimize the affect on the two wells and ensure that no other <br />groundwater users are adversely affected by the dewatering activities at the mine. Please discuss the mining phases jor the site, and the acreage of affected land at any given time. <br />In particular, NCCI is currently approved to mine no more than 10 acres that would cover one <br />section or portions ojtwo sections and with a total disturbance at any time of 25 acres. <br />NCCI plans to maintain the approved 10 acre active mining area at the site. The active mining <br />area will progress through the 7 approved phases as shown on the mining plan map. While the <br />10 acre active mining area will remain the same as the approved plan, NCCI proposed to <br />increase the allowable total area of disturbance from 25 acres to potentially the entire area <br />planned to be mined. The total area of disturbance would include, at any point in time, the <br />current active mining area, the previously mined areas, the overburden stockpile areas, and the <br />processing area. <br />NCCI's intent is to complete the reclamation of previously mined areas as soon as possible after <br />they are mined in order to minimized the total area of disturbance at the site. Because NCCI is <br />currently in negotiations with an end use buyer for the pit, and is in the process of determining <br />what they will require the pit liner system to be, they have not started the reclamation process. <br />NCCI does not want to construct a liner that may need to be removed and/or re-constructed to <br />meet the buyer's requirements. Once the pit liner requirements have been finalized, it is NCCI's <br />intent to reclaim all previously mined areas concurrently with the mining activities. <br />NCCI will ensure that the Division will have sufficient bond to cover the cost of completing the <br />reclamation of the site.
