Walther <br />E~ecueve Director <br />Michael R Long <br />Division Director <br />NOV CV-2000-06 was issued to Bear Coal Company at the Beaz No. 3 Mine for "failure <br />to mulch and seed during the first normal period for favorable planting conditions". <br />Last October, the operator spread topsoil on approximately 1.5 acres. The permit says <br />they will mulch and seed during the first normal period for favorable planting conditions. <br />This is consistent with Rule 4.15.3. The azea was not seeded last fall. In March, April, <br />May and June, 2000 the inspectors reported that the area needs to be seeded. I conducted <br />an inspection on July 13, 2000 and the azea was dense with annual weeds. Lambsquarter, <br />Russian thistle and annual sunflower were the dominants. Some of the plants were over <br />four feet tall. These annuals are depleting valuable soil nutrients and moisture. Widely <br />scattered grass plants and an occasional sweetclover plant were observed below the <br />annual weed cover. <br />Pictures of the violation aze attached. <br />
