1 • • <br />-2- <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance withi <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby <br />finds the Cooley Gravel Company to be in violation of Permit M-73-021, <br />specifically Exhibits D and E and the Mine and Reclamation Plan Maps, and <br />C.R.S. 34-32-116(7)(h) and (i>. <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders the Cooley Gravel Company to: <br />1. Cease and desist from conducting the following mining operations at the <br />Morrison Quarry - Permit M-73-021: Any mining activity on or below the east <br />wall of the quarry. <br />2. Mail, within one (1) day after receipt of this Notice, to the <br />Mined Land Reclamation Board, written notice of your complian~:e with paragraph <br />one (1) of this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Submit an amendment to the permit by August 21, 1993. The amendment <br />must include, at a minimum: <br />A clarification of the mining plan that clearly states bench <br />configurations, backfill dimensions, and additional changes <br />deemed necessary by the results of the engineering study. <br />2. Adjustment of the reclamation plan to match the mine plan <br />3. An engineering study that demonstrates the nature of the slope <br />stability problem on the east wall and how this problem will be <br />corrected. <br />4. A recalculation of the reclamation bond that accurately <br />reflects the adjusted mining and reclamation plans. <br />The operator must obtain approval of the amendment by <br />December 21, 1993. <br />b. The operator must perform an engineering study which demonstrates <br />characteristics of the rock to be mined along the east wall of the <br />future quarry as mining proceeds to the south. Within 30 days of the <br />signature date of this document, the operator must propose a due date <br />for this study. Such a date must be acceptable to the' Division of <br />Minerals and Geology. <br />
