ISSUES TO BE CONSIDERED <br />Presentations to the Boazd shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et sue, C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Boazd. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />1. Has the applicant provided an adequate engineering stability analysis.for the proposed <br />final reclaimed slopes of the riverbank and a stable post-mining topography? (34-32.5- <br />116(4)(1) and Exhibit 6.5 (2) of the Rules and Regulations) <br />2. Will all surface azeas of the affected land within the proposed amendment area be <br />stabilized and protected to effectively control erosion? (34-32.5-116(4)(h) and Rule <br />3.1.6(3)) <br />2 <br />
