D % S~ <br />Dear Mr. and Mrs. Van Ella: <br />This letter is afollow-up to the a-mail the Division sent on March 18, 2005. It is <br />an approximate copy of that March 18, 2005 a-mail, for your records. <br />The Rules and Regulations are in the process of being revised to allow <br />amendments to 110 permits. The form that you are completing or have completed <br />is the existing form that does not allow the option of an amendment. We have, <br />however, decided to allow you to submit an amendment application now rather <br />than later using our existing application form that does not have acheck-off box <br />for amendments. (Please address the completed application to our Ms. Erica <br />Crosby so that we can make sure the administration stafJ'does not return it to <br />you.) I believe that our Ms. Crosby indicated in her inspection report that you <br />should submit an amendment. We apologize for the confusion, but were trying to <br />give you a break on the permitting process by allowing you to submit an <br />amendment rather than having to submit a whole new application. <br />In reference to you're other question. We agree with you that the area has been <br />previously disturbed by other mining operations. We also agree that as long as you <br />do not re-affect those previously affected areas, you are not responsible for its <br />reclamation.
