Banta. <br />Division Director <br />Attached is a copy of the Division's response dated May 3, 1991 to Issue 3 <br />of 4 within the Ten Day Letter (TDL) referenced above. Although, the <br />Albuquerque Field Office (AFO) has not conveyed their finding to the Division <br />in regard to that response, the Division does feel it mist follow thru on the <br />commitment made. Consequently, the Division is requesting that Wyoming Fuel <br />provide by June 5, 1991, an MR proposing that the areas mentioned under <br />Issue 3 of 4 not already designated as exempt from normal surface control <br />measures be so approved and providing the demonstrations necessary under <br />Rule 4.05,2(3) so that such approvals may be made. While the Division is not <br />completely certain that such actions will address all AFO concerns, such <br />action and approvals would appear to the Division to be an acceptable and <br />necessary way to address apparent deficiencies in sediment control measures <br />approved for these areas. <br />If you have any questions, please call. <br />Sincerely, <br /> <br />James C.
