Las Animas County should clarify Mr. Garlutzo's extension request <br />and present this request to our Board during the upcoming August <br />27-28, 1986 meeting. Specifically, you should request an <br />appropriate extension of the time limits by which you were <br />ordered by the Board to: <br />a. Get a limited impact permit for the less than 10 recently <br />disturbed acres of the "Makloski Pit" east of Aguilar; <br />b.• Pay the 59,300.00 civil penalty assessed against Las Animas <br />County for mining without a permit at the "Makloski Pit"; <br />c. Pay the E3, 800.00 civil penalty assessed against Las Animas <br />County for mining without a permit at the "Cappellucci Pit"; <br />and, <br />d. Finally resolve payment of the remaining E3,000.00 civil <br />penalty assessed against Las Animas County in 1983 for mining <br />without a permit at the pit now permitted under permit number <br />M-83=039. <br />2. Las Animas County should identify a candidate site or sites for <br />doing reclamation in lieu of payment of the total civil penalties <br />of $16,100.00 now owed to the State of Colorado. Such sites <br />should be areas mined pre-law (prior to the Mined Land <br />Reclamation Act). They should preferably be on public land <br />and/or be on land whose reclamation can be shown to be in the <br />public good (e. g.: reclamation resolves public safety hazards). <br />The County would then be able to submit these sites to use for <br />evaluation as to their appropriateness before proceeding further <br />with them. It could be necessary for the Board to approve these <br />sites during a regularly scheduled meeting. <br />3. A plan for doing this reclamation in lieu of paying the civil <br />penalties would be submitted in the form of one or more <br />reclamation-only permit applications. As a part of these <br />applications, the County should submit total reclamation cost <br />calculations that equal or exceed E16,100.00. Approval of these <br />permits by the Board will put payment of the civil •penalties in <br />abeyance until the reclamation is accomplished and released by <br />the Board. At that time, the civil penalties will::be considered <br />•pai d. <br />4. The "Makloski 'Pi't" area-that was redi•sturbed.a.s~a result ,of Las <br />Animas County's recent mining must .be permitted as per the <br />Board's order. This area (by your description, of somewhat less <br />that 10 acres) cannot be used t??o "work off" your civil <br />penalties. It is required to be permitted as an existing mining <br />operation, since the Board found your activities there to be <br />
