AGREEMENTS <br />Pemrittce and Successor hereby agrce, for their own benefit and for the benefit of the State, such agreements to be <br />effective?t?sQ f~ upon the approval bythe State ofthe transfer ofthe Permit fromPemtitteetoSuccessor asfoIlows: <br />1. Successarhasinspectedtheminingandreclatnationoperationstoitsemiresatisfactionaadisfullyawareof <br />the comlitions thereof Successor understands and accepts all of the conditions of the Permit <br />2. Snecessorwillcompletethereclmnationplan,andherebyass~esliabilityforcompletingsuchplanestoall <br />areas heretofore disturbed; as well as to atl areas hereatier distrsbed. Successor wi11 perform atl ofthe obligations of <br />the Permi[tee under the Permit which have not heretofore been performed by Pemti[tee. <br />3. Successor hereby tenders to the State its attached Performance and Financial Warranties#, which era to be <br />substituted for the Performance andFinsncial Warranties heretofore filedby thePumittee, effective uponthe release <br />of the latter Warranties. <br />4. Successor represents to the State that, to the best of its lmowledge, information andbelieQ itisnot inviolation <br />of arty of the provisions of the Colorado Mined Landreclamation Act with respect to a~ other operationconductedby <br />it in the State of Colorado. <br />Pemuttee and Successor hereby request the State to corsent to the assignment of the Pemrit, torecognize Successor as <br />Successor Operator under the Permit, and to accept the Tendered substitute Performance end Financial Warranties in <br />place of the Warranties presently on file with the State. <br />This form has been approved by the Mined Land Rec4anntion Board pursuant to sections 34-32-1I9, GRS, ofthe <br />Mined Land ReclnmatianAd and 3~h32.S-I19, C.RS., of tJre Colorado Land RecLonationActfor theExlradion of <br />Construction Materials.
