_ • • <br />CEASE AND DESIST ORDER <br />Based upon the foregoinc findings of fact and notice of violation, and <br />pursuant to the provisions of C.R.S. 1973, 39-32-123, 129, the Board hereby <br />orders you to: <br />1. Immediately cease and desist all mining operations. <br />2. To mail, within one (1) day after receipt of this notice, to the N.ined <br />Land Reclamation Board, written notice of your compliance with paragraph <br />one (1) of this cease and desist order. <br />3. To take the following additional corrective actions before this cease <br />and desist order will be lifted and a permit can be issued: <br />a. Submit the 52,500.00 financial warranty and accompanying <br />performance warranty to the Division for approval; <br />b. Submit a written reply to Jim Schmieding's Letter to you <br />of January 29, 1980 that includes a map of the exact <br />permit area; <br />c. Clarify the location of all topsoil stockpiles; and <br />d. Clarify the planned commencement date of reclamation of <br />the permit area and where this reclamation will start. <br />In clarification of the rights of recipients of notices of violations, <br />cease and desist orders, parties are advised to consult the Colorado Mined <br />Land Reclamation Act C.R.S. 1973, 39-32-101 et sec. and 24-4-101 et sue. as <br />amended and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain <br />acts to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this order are <br />advised to consult C.R.S. 1973, 29-9-106, as amended. <br />n -~ L~ <br />Dated at Denver this ~ ~ day of ~ 1982. <br />MINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />n ~/ <br />By ,~ ~~. ~. v,~~~ <br />David C.
