The review is to determine whether a pattern
of violations exists or has existed, and, if a pattern exists,
whether we will require the operator to show cause why the permit
should not be revoked or suspended.
Powderhorn Coal Company was issued three notices of violation
during three separate inspections of the Roadside & Cameo Mines.
The citations, in brief, were:
July 12, 1994 Inspection
NOV C-94-014 Failure to construct sediment pond #11 prior
to disturbance of Cameo Borrow Area #2, and
failure to construct primary and emergency
spillways designed to safely pass the
precipitation event.
October 25, 1994 Inspection
NOV C-94-031 Failure to permit, design and locate three (3)
monitoring wells at the Roadside North Portal
Facility Area.
January 11, 1995 Inspection
NOV C-95-001 Failure to divert surface runoff from CRDA #1
to stabilized channels off the refuse pile
which will safely pass the runoff from a 100-
. year, 24-hour precipitation event.
