<br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Richard Stewart) NOTICE OF VIOLATION M-87-41 <br />South Park Aggregates) AND <br />1 ('.EASE AND DESIST ORDER <br />T0: Richard Stewart and all other persons engaged in or owning or controlling <br />the following operation: South Park Aggregates, Fairplay Ouarry. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. South Park Aggregates is permitted to conduct a mining operation under the <br />terms of Permit M-82-086 located in Colorado, Section(s) 2 and 3, Township 10 <br />south, Range 77 west of the 6th P. M., in Park County, Colorado. <br />2. The t7ined Land Reclamation 9oard conducted a Formal Public Hearing on <br />October 23, 1987 to consider possible violation of the terms of Permit <br />M-82-086 and C.R.S. 34-32-101 et seq. <br />3. The Mined land Reclamation Division presented evidence at the Formal <br />Public Hearing on October 23, 1987, demonstrating that: <br />a. The 5350.00 annual fee and notice of intent to continue mining <br />(annual report) for 1987 for Permit No. M-82-086 were due by no <br />later than October 18, 1987. <br />b. To date, these items have not been submitted to the Mined Land <br />Reclamation Division. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />South Park Aggregates to be in violation of Permit M-82-086, and C.R.S. <br />34-32-110(4). <br />
