We still have a few concerns about the responses and the application in <br />general. These are minor items, and there should be no problem clearing them up quickly, so that <br />the application can be approved. I have listed below the items that need to be completed, corrected <br />or clarified to perfect the application permit. <br />~ti" l) Please provide proof that your responses/changes to the application were placed with the <br />~• copy of the application at the County Clerk and Recorder's office, upon submitting them <br />,~ to the Division. <br />OeVy~) Provide proof of proper public notice of the application. <br />~,, 3) As I discussed with you in the field and in the adequacy review letter, please label the <br />~I.~,~ permit boundary and extend the boundary to include the portions of the mine road that still <br />b remain outside of your latest proposed limits of mining (Permit Boundary). Also, please <br />include the 0.85-acre area (Reclaimed Area to Remain Undisturbed) in the permit boundary. <br />This is part of the area involved with the Board's decision to fmd a violation for mining <br />outside of the permit boundary. The Board ordered that this area be brought into the <br />permit. This area will have to remain in the permit until the Division releases Ouray <br />County from any further reclamation responsibilty for it. <br />b~~) Your application, page 1, shows 17.3 acres as the proposed permitted acreage and your <br />~~," ~ mining plan (Exhibit D) states that 16.06 acres will be in the mining boundary. If there is <br />a 1.24-acre area within the permit boundary that will not be disturbed in any way, please <br />show it. Otherwise, clarify the application and make any necessary changes to all affected <br />exhibits. When you address No. 3 above, the appropriate acreages may change again. <br />Please make the necessary corrections. <br />
