We believe that the changes are quite reasohable, and I <br />hope that we can work out language that is acceptable to bath of us on these few points. <br />1) pg, 4-5, pare 1.~: Unless Contractor requests a modification in such Change Order, <br />Contractor shall sign the Change Order and return a copy thereof to DMC~ and BMRI <br />within to business days after it has received the same. Contractor shall have ten <br />10 business days from its receipt of a Change Order within which to request a <br />modification thereto. Failure of Contractor to respond to a Change Order within such <br />ten ,10) business day period shalt be deemed to signify Contractor's acceptance of such <br />Change Order as if Contractor had signed the same without modification, If Contractor <br />requests a modification of a Change Order, DMG and BMRI shall have five (~) business <br />days from receipt of such request to accept such modification in writing, If not so <br />accepted, such request is deemed to be rejected However. if Contractor's Codification <br />We feel that it is not acceptable to have a Change Order deemed accepted or <br />rejected without our signature or explicit agreement. The last sent3nce is one <br />approach to changing this garagraph so. that it is acceptable to RCG. <br />2) Pg.S, para. 2.2: ,..Contractor shall prepare and submit to DMG and BMRI within ten <br />X101 business days of the occurrenc:e... <br />I may be in the field for a week at a time or longer and would be unreachable by <br />fax and Federal Express.
