Powderhorn is a debtor in possession, in a case administered with its Parent, <br />Quaker Coal Company and I8 other subsidiaries, in the United States Bankruptcy Court for the <br />Eastern District of Kentucky. Powderhorn is incorporated in the State of Delaware. <br />2. Powderhorn owns two coal mines in Mesa County, Colorado, known as the <br />Roadside and Cameo Mines (the "Potivderhorn Mines"), which are subject to Permit No. C-1981- <br />041 ("Permit"), to conduct coal mining and reclamation operations. Approximately two-thirds of <br />the surface is federally managed by the Bureau of Land Management. <br />3. Powderhorn acquired these mines on or about July 1, ] 997. <br />
