N.W. <br />Gig Harbor, WA 98335 <br />RE: Reason to Believe Letter, Permit No. M-78-091UG <br />Dear Mr. Abraham: <br />~~ <br />DEPARTMENT OF <br />NATURAL <br />RESOURCES <br />Roy Romer <br />Governor <br />lames S LochheaA <br />Eaecuirve Director <br />Michael B Long <br />Division Director <br />On July 13, 1995 we conducted an inspection of your permit fde and found that the $12,500.00 fmancial warranty <br />increase was not submitted to the Division by the May 13, 1995 due date. <br />We believe this is in violation of C.R.S. 34-32-117(4)(c)(In of the Mined Land Reclamation Act 34-32-101 et. ~., <br />C.R.S. 1973 as amended. <br />Therefore, we have found reason to believe a violation exists to Permit M-78-091UG and the Law and have <br />scheduled this matter before the Mined Land Reclamazion Board. <br />A Formal Public Hearing will be held during the August 23-24, 1995 Board meeting for consideration of possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning a[ <br />9:00 a.m. or as soon thereafter as the matter can be considered and you will have the opportunity to be represented <br />and heard. It will be reiterated that [here is reason to believe that you are in violation of the provisions noted above. <br />If the Board fmds a violation at Wis hearing, it may issue a cease and desist order, assess a civil penalty in [he <br />amount of $50.00 to $200.00 for each day of violation or order the permit be suspended, modified or revoked. In <br />addition i[ may set Ute matter for consideration of forfeiture of the $31,500.00 financial warranty at a subsequent <br />hearing.
