TWENTYMILE COAL COMPANY - FOIDEL CREEK MINE (C-82-056) <br />STATUS OF ABATEMENT MEASURES FOR NOV CV-2006-006 <br />• Executive Summary: <br />On notification of the coal fines discharge, TCC took immediate emergency steps to cease dischazge, <br />assess and control downstream migration of coal fines, and repair the source of the dischazge. <br />Jurisdictional agencies were notified within 24-hours, and TCC immediately proceeded with <br />assessment of potential water-quality and related impacts, including; assessment of potential toxicity <br />for the dischazged material, estimation of the spilled quantity, and immediate initiation of sampling of <br />both the dischazge and downstream water quality. As soon as reliable information was available on <br />potential water-quality impacts, downstream water owners/users and local officials were notified and <br />provided with relevant information and contact numbers. <br />TCC then worked closely with the CDRMS and other agencies to develop specific clean-up and <br />mitigation plans to address both potential short- and long-term impacts. These plans were submitted <br />for review and concurrence by the CDRMS, USACE, CDPHE-WQCD, and CDOW, prior to <br />implementation. TCC proceeded with implementation of the clean-up and mitigation plans including: <br />• Removal of coal fines accumulations from the Foidel Creek streambed and banks <br />• Reestablishment of sediment and stormwater runoff storage and treatment <br />capacity/capabilities for Sedimentation Pond E <br />• Removal of accumulated coal fines from Sedimentation Pond E <br />• These activities were successfully completed, with no reported adverse impacts to downstream water <br />users, and no indicated significant adverse impacts to drainage characteristics, water quality, or aquatic <br />life in Foidel Creek or downstream drainages. <br />• <br />NOV CV-2006-006 Abatement Report 3 2/7/2007 <br />
