Cease and desist from conducting the following mining operations at the <br />Webb Pit - Permit M-78-323: All mining activities until the following <br />corrective actions are met. <br />2. Mail, within one (t) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective action: <br />Submit by October 1, 1994 a conversion application to convert Permit No. <br />M-78-323 to a Regular (112) permit and obtain final approval of the <br />permit by December 31, 1994. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of $1000.00, within 30 days of the signature date of this <br />document. This is based upon an assessment of $20,000.00 with <br />$19,000.00 suspended upon completion of the corrective actions outlined <br />in this order. The suspended portion is due on January 1, 1995 if the <br />corrective actions are not met. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />c~~~~ <br />Dated at Denver this o+b day of cl <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
