Because the Operator violated the Act, it is appropriate for the Boazd to order the Operator <br />to undertake corrective actions, namely to convert the current permit from a section 110 <br />permit to a section 112 permit to include all of the disturbed azea by July 31, 2006. It is <br />appropriate to further order the Operator to post an interim reclamation bond for the 2.03 <br />acres of offsite disturbance in an amount to be calculated by the Division. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby finds the <br />Operator in violation of Section 34-32.5-116(4)(1) of the Act by failing to protect azeas outside <br />of the affected land from slides or damage during mining operations. The Board hereby <br />orders the Operator to convert the Operator's existing section 110 permit info a section 112 <br />permit to include all affected lands within the new permit by 7uly 31, 2006. The Boazd <br />hereby orders the Operator to post an interim reclamation bond in an amount to be calculated <br />by the Division.
