ul~lotn `~ <br />~®ctrd ~rd~,// <br />~/,xn:~/ZOo~oc~- ~ <br />BEFORE THE MINED LAND RECLAMATION BOARD ~ <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF COLORADO QUARRIES, INC.'S POSSIBLE VIOLATION, <br />CEASE AND DESIST ORDER, CORRECTNE ACTION AND CNIL PENALTIES FOR <br />FAILURE TO PROTECT AREAS OUTSIDE THE AFFECTED LANDS FROM DAMAGE <br />DURING MINING OR RECLAMATION, FILE NUMBER M-1987-027/ <br />THIS MATTER came before the Mined Land Reclamation Boazd ("Boazd") on <br />February 16, 2006, in Denver, Colorado for a hearing to consider a possible notice of <br />violation, cease and desist order, corrective actions and civil penalties for failing to protect <br />areas outside the affected lands from damage during mining of reclamation. The file <br />number in this matter is M-1987-027. Bill Tezak appeazed on behalf of Colorado Quarries, <br />Inc. ("Operator"). Bob Oswald appeazed on behalf of the Division of Minerals and Geology <br />("Division"). <br />The Boazd, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator currently possesses an approved Section 1 I Oc Reclamation Permit fora 6- <br />acre rhyolite mine located in Section 8, Township 22 South, Range 72 West, 6`~ P.M., <br />Custer County, Colorado. <br />2. The Division inspected the site on August 24, 2005 and observed approximately 2.03 acres <br />of mining activity outside the approved permit boundaries. The activity included topsoil <br />stripping, stockpiling, material excavation and hauling. <br />Colorado Quarries, Inc. M-1987-027 ~ <br />
