Proposed Civil Penalty Assessment <br />CV-2005-005 <br />History <br />No enforcement actions have been issued within the past twelve months, <br />Seriousness <br />According to the inspection report only a small amount of topsoil may have been lost as a <br />result of run out from a windrow. The potential for contamination exists. However, <br />based on an analysis presented by TCC the roadbase material will not contaminate the <br />topsoil. However, mixing of road base material and plowed snow is not a good topsoil <br />management practice. <br />$250.00 is proposed for seriousness. <br />Fault <br />According to the correspondence, the operator generally followed the approved plan. <br />The factors that contributed to the violation include the late season in which the road and <br />pad were constructed; the lack of diligence in salvaging all the topsoil resource, lack of <br />buffer for snowplowing operations and lack of diligence in placement of the ditch. TCC <br />is responsible for monitoring the contractor as work is completed. <br />$500.00 is proposed for fault. <br />Good Faith <br />The NOV has not been terminated at the time this assessment was proposed. A good <br />faith reduction is not proposed. <br />Total $750.00 <br />
