Our responses are numbered by <br />your itemized adequacy comments. <br />Adequacy Item No. 1 <br />As discussed at the November 18, 2005 meeting with DMG, Cemex may elect to modify the C- <br />pit CKD storage area as needed to maximize the amount of water that can be pumped and to <br />minimize the surface area of any residual water that may remain at the end of the consumptive <br />use process. Cemex agrees that if accumulated water that meets applicable standards is present <br />in C-pit after the consumptive use pumping has lowered the water level as far as possible that <br />water will not be treated. In the event accumulated water does not meet pH and selenium <br />standards, that water will be treated or wildlife access will be prevented. A Technical Revision <br />addressing treatment for pH and selenium will be submitted before April 1, 2006. <br />Cemex will sample such accumulated water (after the consumptive use pumping has been <br />completed) on a quarterly basis for the agreed list of parameters. Results will be reported to the <br />Division 10 days after receipt of the data. <br />Adequacv Item No. 2 <br />After water is pumped from C-pit, but before it enters the cooling tower, a 20% sulfuric acid <br />solution will be introduced into the flow stream [o lower the pH level to its target range, The <br />target pH range for water entering the cooling tower is 7-9.0 for this process. <br />Adequacv Item No. 3 <br />It is Cemex's understanding based upon our November 18, 2005 meeting with DMG that TR-06 <br />would not require an adjustment to the financial warranty because the consumptive use pumping <br />requires the operation of the cement plant, which the Division would not do. The submittal of <br />TR-07 (water treatment) will include a cost estimate for construction, operation and maintenance <br />of the treatment's'ystem.' .
