This request is necessitated by the inaccessibility of the NW sediment trap <br />due to heary spring rains and rapid snowmelt on site. An inspection of the site and trap on <br />May 18, 1995 revealed that the trap contained approximately eighteen inches of runoff, and <br />the roads to the site require maintenance before the backhce can access the trap. Prior to <br />gravel placement in the trap, the remaining water must be pumped to the explosives bench <br />sediment pond and the trap dried. Sun Coal believes this request is allowed by Rule <br />5.03.2(c)(iv) which sates in relevant part, [circumstances which may qualify a surface coal <br />mining operation for an abatement period of more than 90 days] "where climatic conditions <br />preclude abatement within 90 days, or where, due to climatic conditions, abatement within 90 <br />days would cause more environmental harm than it would prevent." Sun Coal requests that <br />CDMG extend the abatement by eighteen days to June 16, 1995, allowing sufficient drying of <br />the access roads and sediment trap to effect structural modifications. <br />If you have any questions, or require further information please contact Bryan Archer or me. <br />Sincerely, <br />~~~~~_ <br />Michael S.
