Cottony <br />Division Direcor <br />Re: Pre-Hearing Conference Notification, Amendment Application (AM-02) Penrose Ranch Pit, <br />M-1992-016 <br />Deaz Ms. Mramor: <br />As notified on April 1, 2003, the Division received your timely objection to the referenced <br />amendment application on March 31, 2003. You met the requirements of Rule.1.7 so you are <br />now a Party to the heazing process, unless you decide to withdraw. <br />Apre-heazing conference shall be held in accordance with Rule 2.7. The pre-hearing conference <br />will be held at the DMG office here in Denver, Colorado in Room 215, 1313 ,Sherman Streee on <br />the 8`s of May, 2003. The meeting will begin at 1:OOPM and continue until all yourobjection <br />items are addressed. Ms. Sandy Brown has volunteered to chair the hearing. If the hearing <br />chairperson determines that any objection item comes under the Boazd's jurisdiction. a pre- <br />hearing order will be drafted in compliance with Rule 2.7(3). As previously noted, the Board's <br />jurisdiction does not include land use decisions, visual or economic impacts, impacts to public <br />roads, noise and other nuisance and socio-economic issues. Impacts to air quality, surface water <br />quality, water quantity, impacts to threatened or endangered animal species and the protection of <br />historic resources are regulated by agencies other than the Board. The items you are concerned <br />with appear to fall under the jurisdiction of other agencies, most likely Fremont County. <br />The records show that you were properly notified of the amendment application (a signed <br />certified mail return receipt) so your property must be within 200 feet of the proposed affected <br />land area. <br />If you have any questions whatsoever, please give me a call at 303-866-4060. <br />Sincerely, <br /> <br />James Dillie <br />
