However, following the assessment conference, the operator <br />was able to provide evidence that the DMG had previously approved <br />the sediment control methods cited in the NOV. Because the <br />approvals are not in compliance with the regulations, the permit <br />will be revised to address this matter as a permit defect. <br />Therefore, we recommend that this NOV be vacated. <br />
