Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your adequacy responses for the Builders Aggegate Pit Conversion Application 02 <br />(CN-02) faxed to the Division on September 29, 2007. The Division of Reclamation, Mining and Safety <br />(Division) has a few remaining questions that need to be addressed prior to approval of the application. <br />The Division is required to make an approval or denial decision no later than September 30, 2007, <br />therefore, your response to the following adequacy review concerns should be submitted to the Division <br />as soon as possible. <br />1. Thank you for clarifying that the operator of the site is Builder's Aggregate, Inc. However, in doing <br />so, the permit will need to be transferred from Builders Aggregate Co. Inc. to Builder's Aggregate, <br />Inc. This is to ensure that the performance warranty and financial warranty are legally under the <br />correct name of Builder's Aggregate, Inc. Attached is a form that must be completed for the transfer <br />of permit. <br />2. The operator notes that the buffer zone has been armored adjacent to the river for the entire length of <br />the property. Please describe in further detail the armoring (i.e. line by rip-rap, concrete, etc..) and <br />the extent of armoring. Photographs of the lined azea will help clarify the magnitude of armoring <br />along the river. <br />3. Please provide documentation that the site has been approved as industrial by Morgan County once <br />mining is complete. In the event the documentation cannot be obtained from the County, an alternate <br />reclamation plan must be submitted to the Division.
