With Dr. Mayo's <br />assistance, MCC will also initiate internal QA/QC procedures by which MCC can <br />ensure future compliance with its AHR program. Given the non-serious nature <br />of most of the problems at the heart of this NOV, but acknowledging its <br />responsibility for the violation, MCC proposes to accept this NOV provided that <br />(1) the "seriousness" assessment in the proposed penalty assessment is <br />adjusted to the mid-range "low/moderate" level carrying a fine of $750, and <br />(2) the "fault" component in the proposed penalty assessment is adjusted to mid- <br />range "negligence" carrying a penalty of $500. In addition, MCC proposes a <br />good faith credit of $250 to acknowledge its rapid compliance efforts following <br />issuance of the NOV. <br />At your convenience, please advise me as to whether the foregoing <br />recommendation would be acceptable to the Division. Naturally, should you <br />have any questions or concerns, I would be happy to address them.
