As the regulatory• autho;ity with front line <br />jurisdiction, I am troubled when we and the court amve at a significantly different conclusion <br />using the same set of information. <br />Therefore, [ am advocating that we take the following actions: <br />• determine what information, testimony, or evidence was entered during the trial related to <br />the location of mining under and adjacent to the Tatum property, <br />• compare trial information, testimony, or evidence to information used by DMG during its <br />investigation of the citizen complaint related to subsidence impacts to the Tatum home, <br />• determine what action would be possible and appropriate if, based on the previous two <br />actions, we determine that Basin Resources withheld or misrepresented information <br />which was the basis for our findings related to the citizen complaint alleging subsidence <br />impacts to the Tatum home, <br />• take whatever action is deemed appropriate against Basin Resources, or <br />• if no additional information was used by the court, determine what actions would be <br />appropriate in order to preserve our previous decision on the citizen's complaint. <br />Please let me know your thoughts on this issue.
