There are approximately 21 Small Area Exemptions listed in the mine plan. While some of these are actually exempt from sediment control, several have an alternate treatment for sediment control. The mine plan has a narrative description of the method of sediment control for the areas and runoff calculations are provided, however, in most locations it does not contain a design for the method of sediment control. DMG has stated that this would be addressed during the upcoming mid-term permit review. Since no on the ground problems were noted with the controls being used, I agreed to allow the mid- term review process to be used to insure the mine plan complies with Rule 4.05.5. The compaction test indicated that the compaction of the pile was acceptable. A 1992 compaction test indicated that the compaction of the pile did not meet the 90$ needed to insure stability. There was no indication that the pile was recompacted and retested. PCC needs to insure that all compaction test meet the required standards prior to resuming the placement of material on the pile.
