Miller <br /> Marathon Gold Corporation <br /> 50 Spruce Street, No. 400 <br /> Craig, Colorado 81625 <br /> Re: Joker Mine and Pilot Plant - File No. 83-52; Notification of Reason to <br /> Believe <br /> Dear Mr. Miller: <br /> On November 30, 1984, the Division inspected the above site, and noted <br /> possible violations. Based on this inspection, the Division will be <br /> presenting information to the Colorado Mined Land Reclamation Board to <br /> determine if there is reason to believe a violation has occurred. This will <br /> be presented to the Board at the January 23-24, 1985 meeting. <br /> The Division believes the following items are in violation: <br /> 1 . The operator has constructed and was operating an enclosed pilot <br /> cyanide operation on site. The operator stated that detoxified sample <br /> tailings were disposed of in the small ephemeral drainage below the site. <br /> There is no approved provision for this activity in their existing mine permit. <br /> 2. The operator has submitted bond to disturb only 11 acres, as per an <br /> approved revision to decrease financial warranty. The present financial <br /> warranty is inadequate, in that the operator has exceeded ten (10) acres for <br /> the pilot plant site and one ( 1 ) acre of mining. <br /> 3. A waste rock and/or overburden stockpile is on the pilot plant site. <br /> The Division believes these piles are in excess of the temporary "small <br /> stockpiles" originally permitted. The original permit stated that pits would <br /> be backfilled, apparently by applying either a haul backfilling method or by <br /> contemporaneously backfilling. This apparently has not occurred in accordance <br /> with the approved mine plan. <br /> 4. Topsoil stockpiles were not graded 3H:1V, seeded and stabilized. This <br /> is not in accordance with the approved mining and reclamation plan. <br /> 5. The operator has constructed four ponds, the permit allowed for only <br /> three ponds to be constructed. In addition the site drainage control is not <br /> constructed as planned and may not be adequate.
