One of the central <br />issues for the Boazd to decide will be whether the Division appropriately issued the NOV, <br />given the fact that Four Corners Materials is the owner and responsible party for the <br />culverts in question. As the abatements require Oakridge to modify the Cazbon Junction <br />permit to include the culverts covered under the Ewing Mesa permit as well as maintain <br />or remove property of another company, it would seem prudent to allow the Board to rule <br />on these issues prior to requiring Oakridge to complete the abatements. <br />We would request that the abatements be extended for 30 days past the Boazd hearing <br />decision date. <br />Sincerely, <br />Michael S.
