Savage and Savage Environmental
practical solutions for environmental issues
4670 Haystack Drive 970 674 8080 telephone
Windsor, Colorado 80550 970 674 8088 facsimile
savageandsavage@earth li nk.net
October 30, 2007
Dan Hernandez
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: Request for Extension of Abatement Deadlines for NOV CV-2007-005,
issued to the Oakridge Energy Carbon Junction Mine (permit C-92-080)
Dear Dan:
Given Oakridge Energy's request for a formal public heazing before the Colorado Mined
Land Reclamation Board on this notice of violation and the accompanying request for
temporary relief (correspondence to Mr. Harry Javernik of October 17, 2007), I am
requesting an extension to the abatement deadlines for the NOV. One of the central
issues for the Boazd to decide will be whether the Division appropriately issued the NOV,
given the fact that Four Corners Materials is the owner and responsible party for the
culverts in question. As the abatements require Oakridge to modify the Cazbon Junction
permit to include the culverts covered under the Ewing Mesa permit as well as maintain
or remove property of another company, it would seem prudent to allow the Board to rule
on these issues prior to requiring Oakridge to complete the abatements.
We would request that the abatements be extended for 30 days past the Boazd hearing
decision date.
Sincerely,
Michael S.
