Lnng <br />Di~ainn DnCUOr <br />On June 17, 1999, the Division of Minerals and Geology conducted an inspection of your mine on top of Wild Horse <br />Mesa and found a one acre disturbance with approximate dimensions of 225' x 239' x 25' deep which appears to be <br />a mining activity. Pit nrn material is being excavated and transported to other parts of the Melby Ranch Property. <br />However, some of the material is being sold to persons or entities not affiliated with Ivlelby Ranch Propenies. <br />We believe this is in violation of C.R.S. 34-32.5-109 for mining without a permit <br />Therefore, we have reason to believe that a violation of the Law exists, and have scheduled this matter before the <br />Mined Land Reclamation Board: <br />A Formal Public Hearing will be held during the July 27-28, 1999 Board meeting for consideration of passible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. <br />or as soon thereafter as the matter can be considered. At that hearing you will have the opportunity to be represented <br />and heard. It will be reiterated that there is reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at [his hearing, it may issue a Cease and Desist order and assess a Civil Penalty in the <br />amount of $1,000.00 [o $5,000.00 for each day of violation.
